Who gets to keep the home?


Determining who gets to keep the home is a controversial process as the home is commonly the major asset of the parties. Usually, with minor children involved, the parent with custody is granted the home to decrease effects on children, in which case non-custodial parents retain other assets. In some cases the custodial parent is able to buy out the interest of the non-custodial parent, if unsuccessful, both parties remain tenants of the house. However, this option remaining tenants is not desirable as costs of repairs and maintenance could be conflicting.
